The Demise of the 28-Article Peace Proposal for Ukraine: How Peace Negotiations Continue to Stumble

Europe felt a moment of respite on Monday, as the crisis caused by the announcement of a new comprehensive peace framework for resolving the conflict appeared – briefly – to have been defused. A senior US official spoke of "substantial progress" after diplomatic discussions in Geneva. On Monday night, the Kremlin made its retaliation: a renewed assault of rocket attacks on Kyiv.

The Pattern of Negotiation and Warfare

The sequence of contrasting events captured the bleak nature of the outgoing year. By day, political struggles are fought: hopeful statements are released from various governments. Considerable effort is allocated on managing particular approaches. By night, the Kremlin forcefully demonstrates the world that, for them, military action persists as the main instrument for achieving "resolution".

Nighttime Reality

As Russia's attack progressed into the early hours of Tuesday, the present situation of Ukraine's vulnerability was exposed. Ukraine is able to track rocket firings from enemy soil, a capacity enabled by timely intelligence. From observation points, Ukrainian air force fighter jets that had been deployed to engage hostile aerial threats streaked across the sky – advanced fighter aircraft delivered to Ukraine by Western partners.

Moments later, Kyiv's air-defence systems activated: multiple launches fired to intercept a incoming threat. This was a modern interception technology at work, presumably delivered by partner states. Every launch shakes the surroundings, causing tremors. The brief panic quickly gives way to resigned acknowledgment: perhaps the approaching threat won't strike its target this time, protecting urban areas from catastrophe and additional electricity failures.

Ongoing Risks

Following this, a large-caliber weapon fired at a aerial vehicle in the vicinity, part of a defensive team – most likely Western-made equipment. Unfortunately, the bullets missed the hostile drone – it continued its flight toward its objective.

Intermittently, this persisted until dawn. Kyiv awoke to the daybreak reports: several casualties, devastation and heating outages in many homes as a result of the night's assault. As typically, everyone still continued their routines – enduring hostilities. But those entire period encapsulated Ukraine's essential dependence on international aid – a dependence that European nations are evidently unprepared to fill in the short term.

Failed Diplomacy

The comprehensive proposal from Washington generated strong feelings, discussion and serious worry – and temporarily diverted attention from Ukraine's major integrity crisis in years. Yet, we have seen this script before, after previous diplomatic encounters and bilateral conferences.

Every new approach from US leadership follows the consistent cycle: a diplomatic cavalry charge against Ukraine, which Kyiv, with partner nations, effectively counters. They manage the tension but never actually secure success. This cycle will, no doubt, continue.

Strategic Calculations

It is convenient to criticize specific actors of persistently promoting Moscow's conditions. But that does not seem to be the complete picture. American leadership works based on a principle familiar among seasoned negotiators: you cannot win at the negotiating table what you have been unable to protect through force. The US administration believes that it is unfeasible to pressure the Kremlin to relinquish the land that it presently holds in Ukraine's south or east.

The problem is that while accepting these circumstances, American administration does little to prevent Kremlin actions, through statements or actions, from thinking that the status quo will not shift further in its benefit in the months ahead.

Opposing Positions

Therefore, Moscow is certain that the clock favors them – that Ukraine and its supporters are coming close to fatigue. Their incentive to accept conditions that does not give them the largest achievable advantage is virtually nonexistent. There may be many attempts to end hostilities, but they will persist as long as Russia's leadership remains completely certain in the outcome.

On the contrary, Ukraine's government believes that Ukraine can still persist, gradually sacrificing civilians and areas but averting a total frontline collapse until situations evolve in its advantage.

Existing Situation

Realistically, there are no genuine requirements for a ceasefire. Now, individual motivations are entering the equation: personal goals to broker a ceasefire and obtain worldwide acknowledgment, and the government's twin challenges – on one hand, not to distance important partners, and on the other, to mobilize citizens around the flag against any plan Kyiv finds unsuitable, so that their attention does not move to homefront challenges. And although their objective will now be considerably more difficult after current events, it remains very improbable that this will alter their fundamental strategy.

These opposing factors are influencing discussions.

Conclusion and Outlook

It took a just a single week to eliminate the proposed articles of the most recent proposal. Forceful and unpredictable management of the matter by American leadership, opposition by Ukraine and the other European countries, along with calming attempts of diplomats, and finally, recent disclosures, all achieved their purpose.

While new plans based on previous concepts are imminent, Kyiv, London and other allied nations should arrive at a critical understanding: Ukraine and Europe will only be able to counter diplomatic offensives from Washington that are based on Russian demands and demonstrate certain reluctance to change the course of events, if they maintain solidarity and strengthen their defence capabilities at a considerably quicker tempo. If they do, neither political nor armed coercion will be able to overcome them. In the meantime, Ukraine's ability to counter nocturnal attacks will, for the predictable period, mainly require sustained allied backing.
